last month my heat went out and it cost me 9800 dollars to fix. but i paid 4900 up front meaning i "owe" another 4900. Guy never comes for the other half, 4 wks later he calls me, so i think i get to keep it at this point, what do u think? :)

You still owe it. You could end up paying a lot more in interest and legal fees if you don't. And your credit will suffer.
