If we want to make our own FN, what are our liabilities for limiting access to minors? If we slap a “by using this you agree you’re over 18” are we good? Or is there more we have to do to ensure we’re not sued? I have been on the fence about making a VN for a while and the recent discourse has me second guessing myself.

The best thing you can do is put 18+ everywhere you can and to make sure itch .io recognizes your game as adults only. I would put it in the menu of your game, the first things on your itch page, and all over your social media profiles.

The good news is that no one (to my knowledge) has been successfully sued for the reasons you're describing. The bad news is that legislation (in the US) is changing. KOSA is a bill that will be aiming to make the internet a lot more scary for folks who consume and/or create 18+ content. Each state also has its own laws regarding this. Payment processor companies (Visa, Mastercard, etc.) are beginning to prepare for this change is legislation, which is part of the reason why we're seeing some changes in Patreon and Gumroad terms of service. The future of the internet is not looking great if things keep going the way they are.

At the end of the day, if you feel inspired to write a story, please go and do it. There's always some inherent risk with creating art. But that's why artists are very cool and brave people 😌💖
