is this in America? I thought usually the adult/child thing is decided by prosecutors/judges before the trial, before a verdict is reached? Anyway the context and case details matter, or maybe put more simply: if he would have been tried as an adult at 13, then yes, treat him as an adult now...if not, then as a child
